A federal appeals court has upheld a ruling ordering Donald Trump to pay $5 million to author Jean Carroll after a jury found him guilty of sexual harassment and defamation of the former magazine columnist.

Details: A three-judge panel of the 2nd U.S. Circuit Court of Appeals in Manhattan unanimously rejected Trump’s argument that the trial judge should not have allowed the jury to hear evidence of the Republican’s alleged past sex crimes, making the trial and sentence unfair.

The court said the evidence, including Trump boasting about his sexual prowess in an “Access Hollywood” video that surfaced during the 2016 presidential campaign, established a “repeated, idiosyncratic pattern of behavior” consistent with Carroll’s allegations.

“Considering the record as a whole and considering the strengths of Ms. Carroll’s case, we are not persuaded that any asserted error or combination of errors in the district court’s evidentiary rulings affected Mr. Trump’s substantial rights,” the court said in an unsigned ruling.

The May 2023 sentencing stemmed from a 1996 incident in a Bergdorf Goodman dressing room in Manhattan where Carroll, now 81, said Trump had raped her, as well as an October 2022 Truth Social publication. in which Trump called Carroll’s statement a hoax.

Although a jury in Manhattan federal court did not find that the 78-year-old Trump committed rape, they awarded the former Elle columnist $2.02 million for sexual harassment and $2.98 million for defamation.

In January, another jury ordered Trump to pay Carroll $83.3 million for defamation and damages to her reputation in June 2019, when he first denied her rape claim.
