Details: The judge ordered six federal agencies – the Ministry of Veterans, Agriculture, Defense, Energy, Internal Affairs and Treasury – to immediately renew the dismissed employees. The judge said he could later extend this order to other federal agencies.

According to the court, the management of personnel management (OPM) illegally ordered the dismissal of employees who were on the probationary period. The agencies used a standard letter stating that the dismissal was due to insufficient productivity, although the judge called it a justification to bypass the legislation.
“The reason why OPM tied the release to productivity was, in my opinion, at least partially, a trick to avoid the law on staff reduction,” Alsup said.
Direct Alsup language: “This is a sad day when our government is releasing a good employee and says it was done on the results of work, although they know that it is a lie. This was not to happen in our country. It was a deception to try to avoid legislative requirements.”
Details: The court also criticized the Ministry of Justice for refusing OPM leader Charles Ezella to interrogate, as well as for withdrawal of the application that served as the only proof of the government in this case.
“You are afraid to do this because you know that cross -interrogation will reveal the truth,” Alsup said.
“You do not help me know the truth. You give me press releases – fictitious documents,” the judge stressed.
On Thursday, the Ministry of Justice reported that it would appeal to this decision before the 9th District Court of Appeal.
The White House called this decision “absurd and unconstitutional.”
“The President has the authority to exercise the powers of all executive power – some judges of the district courts cannot abuse the powers of the entire judicial system to interfere with the agenda of the President,” the White House Prescribe, Caroline Livitt.
According to Reuters, as of March 5, about 25,000 workers were released in the US government, and another 75,000 were released with compensation.
