Proceedings under Part 3 of Art. 436-2 of the Criminal Code of Ukraine – justification, recognition as legitimate, denial of the armed aggression of the Russian Federation against Ukraine, glorification of its participants, was opened as a result of two appeals (one from a people’s deputy, the other from a private citizen).
The pre-trial investigation is entrusted to the Main Department of the Security Service of Ukraine in Kyiv and the Kyiv region, the Kyiv City Prosecutor’s Office carries out procedural management.
Prehistory:
- Volkov, as a former associate of one of the leaders of the Russian opposition, Oleksii Navalny, has a temporary residence permit in Lithuania.
- On January 5, 2026, Anna Tyron, a former employee of the Foundation for Combating Corruption, one of whose heads is Volkov, who now works in the RDK, published a message from Volkov, which he wrote to her after the news of the alleged death of the RDK commander Denys Kapustin (later it turned out that his “death” was staged by Ukrainian military intelligence). In this message, Volkov congratulated the death of Kapustin, calling him a “Natsyk”.
- Also, the Russian oppositionist called at that time the head of the Main Intelligence Directorate of the Ministry of Defense of Ukraine Kyryl Budanov “a despicable rural political technologist” and said that he hoped that he, as well as the former head of the Office of the President of Ukraine Andriy Yermak, and the adviser to the OP Mykhailo Podolyak, would “sit down.” At the same time, Volkov noted that both the probable death of Kapustin and the persecution of Ukrainian officials would benefit Ukraine.
- The Department of Migration of Lithuania turned to the DDB for additional consultation regarding a possible threat to national security and with a request to give an assessment of Volkov’s statements that appeared in public space.
- The Prime Minister of Lithuania, Inga Ruginene, called Volkov’s statements unacceptable and noted that “such a person should not stay in Lithuania.”
