The creation of the “white business club” on the initiative of the chairman of the Committee of the Verkhovna Rada of Ukraine on Finance, Tax and Customs Policy, Danylo Hetmantsev, is an anti-reform approach. This law does not contribute to the detinization of the economy, as stated by its initiator. Such an opinion in an exclusive comment UNN said Andrii Dligach, head of Advanter Group, co-founder of the Center for Economic Recovery.

Context

During the analysis, experts of the independent analytical platform “Vox Ukraine” came to the conclusion that the creation of a “white business club” in Ukraine became the first anti-reform in a long time.

We immediately declared – even before the decision was made (the adoption of the law as a whole – ed.) that this was an anti-reform approach. There is a purely economic and social issue here. Social – such segregation of business is definitely not in favor of the development of integrity. The state should treat all business as virtuous. Any ideas with clubs of white business are definitely not ideas in favor of the development of integrity. The second is that only a few percent of businesses will fulfill the purely economic criteria specified in the law

According to him, the analysts conducted simulations with the participation of more than 200 enterprises that have the opportunity to enter the “white business club” and came to the conclusion that white virtuous businesses do not meet the criteria either because of the specifics of the business model they use or because of the situation which has developed in a certain industry.

Accordingly, the criteria selected (in the law – ed.) are not criteria of integrity. These are criteria for evaluating something else, but certainly not business integrity

In addition, according to him, Hetmantsev’s “white business club” does not contribute to the detinization of the economy.

We modeled and did not see a single business that would make sense to change something in its own tax system. Even for those who are gray businesses, with gray salaries, they do not get additional arguments in favor of detinization. That is, this idea is false, will not work, and is socially inadequate

He is convinced that the government should cancel “this stupid idea, like other stupid ideas that happen from time to time, and start making real changes.”

According to Dligach, it is necessary to carry out a liberal tax reform, change the tax administration and abandon the SMKOR system, which allows tax officials to block tax invoices. In addition, according to him, it is necessary to reboot the DPS in the same way as the customs and the Bureau of Economic Security are rebooted.

The Verkhovna Rada of Ukraine adopted in general the scandalous draft law of the chairman of the tax committee of the parliament, Danylo Hetmantsev, on the “white business club”. Both Hetmantsev’s colleagues in the parliament and experts criticized the document. Even in the legal opinions it was indicated that it does not correspond to the legislation of Ukraine.

In the comments UNN economic experts pointed out that the document violates the Constitution of Ukraine and creates discriminatory conditions in the business environment.

Analysts of the Union of Ukrainian Entrepreneurs also conclude that Hetmantsev’s draft law contains discriminatory norms and has corruption risks.

Business ombudsman Roman Vashchuk also stated that the bill on the “white business club” is discriminatory.
