The Cabinet of Ministers approved the draft law regulating the forced evacuation of children from the war zone, as well as the draft law establishing administrative responsibility for curfew violations.

Details: On December 20, the Cabinet of Ministers approved a number of draft laws. In particular, the meeting approved the project of the law “On Amendments to Certain Legislative Acts of Ukraine on the Settlement of the Issue of mandatory evacuation“. The draft law proposes to make changes to the Code of Civil Protection of Ukraine in the part of regulating mandatory evacuation in a forced manner of children who fall into areas of military (combat) operations, zones of armed conflicts and settlements close to areas of hostilities; clarification of the powers of state authorities in implementation of evacuation measures, in particular mandatory, elimination of the gap regarding the ban or restriction of entry (entrance), stay of the population in settlements from which mandatory evacuation is carried out.
Amendments to the Family Code of Ukraine and the Law “On Childhood Protection” are also foreseen in terms of the duties of parents (or persons who replace them) to take care of the child’s safe living conditions; to implement the decisions of the military administrations regarding the implementation of measures for the compulsory evacuation of children; clarifying the rights, duties and responsibilities of parents for the education and development of the child.
In addition, the Cabinet of Ministers approved the draft law “On Amendments to the Code of Ukraine on Administrative Offenses Regarding Strengthening Liability for Violation of the Requirements of a Special Legal Regime – Martial Law Introduced in Ukraine or in Some of Its Localities.” It is proposed to establish an administrative one responsibility for violation of entry (entrance), staying in settlements from which general mandatory evacuation is carried out, in the absence of specially issued passes or certificates, as well as for violation of curfew by citizens. Provision is made for giving police authorities the right to conduct administrative detention of violators.
The Cabinet of Ministers also approved the draft law “On the Unified State Register of War Veterans”. It is proposed to define the essence and content of the Unified State Register of War Veterans, the main terms; subjects, objects, order of use and functions; the procedure for entering, processing, using and distributing information; interaction with other electronic systems, etc.
Prehistory:
- In January 2024, the Council did not find votes to support the second reading and the draft law as a whole on administrative responsibility for curfew violations.
- In May, the Verkhovna Rada also did not vote for the law on administrative responsibility for curfew violations in its repeated second reading and completely rejected it.
