Protected categories in the banking system include:
a) servicemen of the Armed Forces of Ukraine, other legally formed military formations and special law enforcement agencies, the State Special Transport Service, the State Service for Special Communication and Information Protection of Ukraine, who are serving military service on the territory of Ukraine;
b) military personnel who became disabled as a result of an illness connected with military service, or as a result of such an illness, but after discharge from service;
c) family members of servicemen who died, died or went missing;
d) persons who are in captivity or with whom communication has been lost, or who have disappeared.
A person acquires the status of missing from the moment of entering information into the Unified Register of Persons Disappeared Under Special Circumstances.
To confirm the fact of disappearance, it is necessary to submit to the bank an extract from the Unified Register of persons who have disappeared under special circumstances. It can be obtained online upon request to the Single window for citizens.
Documents can be submitted to the bank by:
a) close relatives (husband or wife, children, parents, brother, sister, grandfather, grandmother);
b) the authorized representative of the missing person (on the basis of a notarized power of attorney or other document confirming authority);
c) guarantors under the credit agreement, if they bear obligations to the bank;
d) property guarantors under mortgage contracts.
If a person’s status changes (the missing person is recognized as a captive or vice versa), relatives or representatives must inform the bank about this and provide documents.
The bank after receiving the documents:
a) registers submission of documents and enters information into internal accounting systems;
b) establishes the status of a person as belonging to a protected category;
c) takes measures to preserve banking secrecy and the client’s funds (temporarily blocks the accounts of the missing person to prevent unauthorized transactions; stops forced collection of debt or foreclosure of the property of such a person; limits access of third parties to accounts and financial information);
d) informs close relatives or authorized representatives about the actions taken and the legal consequences of establishing the status of a protected person;
e) if necessary, issues a certificate that the client or his family belongs to a protected category.
This status is valid for the entire period of martial law and for another 90 days.
Establishing the status of a protected person is a powerful tool for protecting the families of soldiers who have gone missing. This allows you to preserve property and financial assets, avoid illegal charges. It is important that relatives timely submit an extract from the Unified Register and inform the bank about changes in the person’s status.
