The BGH found the objections to the arrest warrant unpersuasive and confirmed both the strong suspicion of a criminal offense under the jurisdiction of the Prosecutor General and the grounds for arrest, namely the risk of flight.

After extradition from Italy, Serhii Kuznetsov has been in custody in Germany since the end of November 2025 as part of a preliminary investigation.
In Germany, the Ukrainian is accused of coordinating the actions of the crew of the sailing boat, from which divers installed explosive devices on three pipelines that are part of the Nord Stream gas pipeline, and of participating in their detonation on September 26, 2022.
Ukrainian Serhii Kuznetsov was arrested in August 2025 in the Italian city of Rimini, a few days after the German Federal Prosecutor’s Office issued a European warrant for his arrest. Kuznetsov became the first person arrested in the case of undermining the Nord Streams. In Germany, several charges were brought against him, including an article about a terrorist attack. He pleaded not guilty in court.
In the fall of 2022, both Nord Stream gas pipelines suffered serious damage as a result of explosions – three of the four pipelines were destroyed.
The gas pipeline was built to deliver Russian gas to Western Europe. The highway cannot be restored. Investigations by Sweden, Denmark and Germany showed that gas pipelines were blown up, but the culprits are still being identified.
Russia does not participate in the investigation. Moscow placed the responsibility for what happened on the USA and its allies. They deny their involvement.
Numerous Western mass media reported that the explosions were organized by people connected to the Ukrainian special services. Kyiv denies the accusation of organizing sabotage.
