The dispute began in 2020, when Epic deliberately bypassed Google’s payment system in the Fortnite game, which led to the removal of the game from the store. Unlike a similar claim against Apple, which Epic mostly lost, the matter against Google was successful thanks to evidence of secret revenue distribution agreements between Google, smartphone manufacturers and game developers.
Epic has already announced the launch of its own Epic Games Store store on the Google Play Store. At the same time, Google announced the intention to challenge the decision in the US Supreme Court and warned potential risks to user security.
The Court of Appeal rejected Google arguments that the company is competing with Apple in the total mobile application market. The judges emphasized the fundamental differences between the “closed garden” Apple and the “open distribution” of Android, which creates different market conditions.
