It is a case that combined four interstate complaints against Russia to the ECtHR by Ukraine and the Netherlands:
- Ukraine against Russia (No. 8019/16) – violations during the armed conflict in the Donbass, in particular the killing of MH17, torture, forced labor and more;
- Ukraine against Russia (No. 43800/14) – abduction and illegal movement of Ukrainian children to the Russian Federation in 2014;
- The Netherlands against Russia (No. 28525/20) – the circumstances and consequences of beating MH17 flight;
- Ukraine against Russia (No. 11055/22) – gross violations of human rights during a full -scale invasion from February 24, 2022.
The court unanimously acknowledged that he had jurisdiction on the complaints about events that took place until September 16, 2022, when Russia’s membership in the Council of Europe ceased.
The court found the Russian Federation guilty of numerous human rights violations that took place in the occupied territories before and after February 24, 2022, and their mass and systemic nature.
It is about the arbitrary killings of civilians and prisoners of war, imprisonment, inhumane treatment, the use of torture, the ignoring of Russia by the consequences of its strikes for the civilian population, the systemic practice of suppressing Ukrainian identity, including through the education system, the practice of “filtration”, the export of Ukrainian children.
The court also found that the MH17 flight over the Donbass was beaten by the Russian Buk’s SC and Russia is responsible for making it possible.

- The Ukrainian judge in the ECtHR Mykola Hnatovsky noted that this is probably the largest and most important case in the history of the ECtHR.
- This case is unprecedented: 26 states and one international organization as third parties joined it.
