Sydney designer Katy Jane Taylor, who sells clothes under her birth name Katy Perry, sued the singer in October 2019 over the singer selling her own merchandise.
It is worth noting that the name of the designer is written in English as Katie Perry, and the name of the singer is Katy Perry.
Perry, whose real name is Kathryn Hudson, on Friday successfully challenged a 2023 Federal Court finding that her firm Kitty Purry had infringed trademark rights during a 2014 Australian tour.
A three-judge panel of appeals unanimously overturned the original findings and ordered that Taylor’s trademark be revoked.
The judges said Perry used her name as a trademark five years before Taylor started her business, adding that by then Perry had established an international reputation in the entertainment industry.
The designer compared her legal process with Perry to “David and Goliath”. After Friday’s decision, she told the Sydney Morning Herald that she was “devastated” by the outcome of the case.
Both women have put blood, sweat and tears into developing their businesses. When the fame of one of them grew internationally, the other found out about the existence of her namesake and applied for trademark registration,
