According to the investigation, for the first time the man left the unit without the permission of the command in December 2024. In February 2025, he took advantage of the legal opportunity to return to the service without criminal liability, but in the fall of the same year he again submitted to the SZCH (voluntarily leaving a part). A similar case was recorded in October 2025.

Given the repetition of offenses under martial law, the court found him guilty of voluntarily leaving a military unit under martial law (Part 5 of Article 407 of the Criminal Code) and sentenced him to five years in prison.
