“The highest criminal court of Germany made a decision: the alleged saboteur of the Nord Stream gas pipeline remains in custody. In the relevant decision, the court spoke publicly for the first time about the high-profile details of the investigation,” writes Der Spiegel.
According to the December 10 court ruling, made public this week, the explosions on the gas pipelines “with a high probability” were carried out “at the behest of a foreign state.” It follows from the text of the document that the court connects this with Ukraine.
The decision was made based on the results of the defense’s complaint about detention. As Der Spiegel notes, Serhiy K., a former serviceman of the special forces unit of the Armed Forces of Ukraine, is in a German detention center after being detained in Italy in 2025.
The General Prosecutor’s Office of the Federal Republic of Germany accuses him of sabotage, causing an explosion and destroying infrastructure facilities. The court rejected defense arguments to grant the suspect functional immunity, noting that the Nord Stream gas pipelines were not a legitimate military target, as they were mainly used for civilian gas supply.
The Federal Court of Germany also emphasized that as a result of the attack, the sovereignty of Germany was violated, because the gas pipelines ended on its territory and were supposed to ensure the supply of gas.
The conclusion of the German federal court has the character of a so-called “reference decision”. The Higher Land Court in Hamburg, which is likely to hear the case, should refer to it in the event of legal proceedings.
What preceded: At the end of November last year, Italy extradited Ukrainian Serhiy Kuznetsov to Germany, who is suspected of involvement in the 2022 blow-up of the Russian Nord Stream pipeline.
According to The Wall Street Journal, German investigators believe that the group of Ukrainians who allegedly blew up “Nordic Streams” acted under the leadership of the then Commander-in-Chief of the Armed Forces Valery Zaluzhny.
