Ukraine must achieve the CBAM’s eclamps delay in order to fulfill the terms of the mineral agreement.

State Flag of UkraineState Flag of UkraineDelaying the mechanism of carbon adjustment of imports (CBAM) for Ukrainian business is a critical task that should be one of the priorities of the new government. This will protect the mining industry, save the jobs and fulfill the obligations within the recently signed agreement between Ukraine and the US with respect to critically important minerals. This was stated by the executive director of the national extractive industry of Ukraine (Nadpu) Kseniya Orinchak.

According to her, all attention is now focused on the opportunities that have a new government composition to communicate with the European side. In particular, the expert expressed the hope that Economy Minister Taras Kachka, who was directly involved in the CBAM implementation process, would be able to establish a systemic dialogue with the European Commission to achieve force majeure delaying this mechanism for Ukraine.

“There should be a state position. We, as an association, have repeatedly turned to the European Commission, received intermediate answers, but further the process did not move. Communication from the Ukrainian authorities simply stopped,” she said.

In her opinion, white business – in particular, extractive companies that supply raw materials for the defense industry and fortifications – need not only support but also protection. She emphasized that since 2026 the CBAM duty of 150 euros per tonne will not come to the Ukrainian budget – these funds will receive the European Union.

“We need to achieve force majeure for Ukrainian companies. After all, today our extractive industry is the basis of industrial safety. And any stop of these enterprises will turn multiplier from the budget. We have to do the fossils, “she said.

The expert also stressed that in 27 EU countries CBAM is introduced flexibly, with many benefits and exceptions for national companies. Ukraine does not have a similar protection mechanism, despite the fact that it is not a full member of the EU and has not yet adapted European legislation in full.

“While we are not in the EU – we need our own mechanism, an analogue of CBAM, taking into account national features. We are a big resource country. This should be part of public policy,” she summed up.

It is known that before the full launch of the European CBAM duty there is just less than six months. And if Ukraine does not receive a deferral, in the next couple of years, according to the Federation of Employers, it will lose $ 4.7 billion exports and $ 2.7 billion investments. Also, according to analytical centers, we can lose 6.4% of GDP by 2030, and more than 116 thousand jobs.

The Ukrainian authorities have already started negotiations on delaying this duty for Ukraine, but there are no results yet. Businesses and experts urge the government to speed up negotiations – because our country is definitely entitled to defer under EU law.
