This is stipulated by the project of the new Labor Code, which is being developed by the Ministry of Economy. Thus, the document proposes to introduce monitoring of the employee’s work correspondence and other data, which is referred to in Article 31.

“The employer may monitor the employee’s work correspondence and/or documents (files) created on technical (electronic) devices used by the employee to perform work duties,” the draft Labor Code says.

At the same time, it is noted that such monitoring “is an extreme form of employer control” over an employee and can be applied only if it is impossible to use alternative methods of monitoring the employee’s performance of labor duties.

It is emphasized separately that the employer must inform his employee about the introduction of monitoring and justify the objective necessity of its implementation.

“Monitoring work correspondence and/or documents (files) created on technical (electronic) devices used by an employee to perform work duties cannot violate the employee’s right to personal and family life,” the document states.
