As the adviser to the Minister of Culture Dmitry Zolotukhin explained, more than 500 men have escaped from Ukraine with such letters.
“Only in 2024, mostly in its first half, when the legislation on mobilization was strengthened, more than 500 men who left with the help of letters-propositions of the MKIP did not return from abroad. The Criminal Code of Criminal Code of Ukraine was violated by the National Police for each such case.
In particular, he said, the proceedings are opened under Art. 332-3 (illegal crossing of the state border of Ukraine in a special period). At the same time, the officials of the ministry automatically become involved in these criminal cases, as law enforcement officers investigate the issues of organizing the illegal crossing of the border.
The adviser explains that the Ministry of Culture does not grant permits to cross the border because it does not have such powers, but sends letters-proposal to the State Border Service, where the decision on the feasibility of crossing is made.
“At the same time, it is accepted solely in the presence of a long package of accompanying documents from a man of conscript age. If there are no documents, then the permission of the SPSU can not provide, and therefore the ICSC will not be sent a letter, because such a protocol,” Zolotukhin wrote.
According to him, proposal letters exist outside the legal field-there is no document that would regulate the right of the Ministry of Culture or any other department to apply to the STSU with such a request during martial law. It was a temporary event introduced in 2022, but it has not yet been settled.
