She clarified that the main goal of the new law is to create opportunities for military personnel who voluntarily left their units to return to their units by January 1 and “continue their service without remorse and without conflict with the legislation of Ukraine.”

According to a representative of the bureau, lawmakers have developed a special algorithm for returning servicemen to service. In particular, military personnel who voluntarily left military units or places of service or deserted before the law entered into force have the opportunity to voluntarily, but no later than January 1, 2025, arrive at the relevant military units to continue military service.
“The head of the military unit no later than 72 hours from the day of their arrival at the military unit or the place of service extends the validity of the contract, as well as renews the payment of monetary, food, material and other types of support,” – reports the SBI with reference to Sapyan.
As the spokeswoman adds, all benefits provided by the state are renewed for such a serviceman. Also, the commander must notify the pretrial investigation body and the military law enforcement service that the serviceman’s contract continues. This will guarantee the start of the automatic procedure of closing the criminal proceedings.

At the same time, if the soldier does not return to duty by January 1, the criminal proceedings may end in a verdict. Sapyan emphasizes that if found guilty of voluntary termination or desertion, the accused faces up to 10 years in prison.
On November 21, the Verkhovna Rada adopted in general the law on the voluntary return to service of those who voluntarily left a military unit or deserted for the first time.
It provides that, during the martial law, servicemen who first voluntarily left the military units, but later voluntarily arrived at the place of service, the validity of the contract continues. Cash payments are also being renewed.
