The Cabinet of Ministers has prepared the procedure for providing in 2025 guarantees for compensation of damage caused as a result of the armed aggression of the Russian Federation and military actions on the territory of Ukraine to domestic and foreign shipowners. The Ministry of Development of Communities and Territories of Ukraine published the relevant project of the government resolution, reports Ukrinform. The project provides for the provision of guarantees of compensation for damage caused as a result of Russia’s armed aggression to charterers, operators and/or owners of sea vessels and inland navigation vessels, as well as the creation of favorable conditions for ensuring stable shipping in the territorial sea of Ukraine and ensuring the operation of a temporary sea route for export-import logistics from/to the Ukrainian seaports of Great Odesa. As noted in the Ministry of Development, currently, in accordance with established practice, the standard exclusions from insurance coverage include insured events that occurred during a state of emergency, special or martial law, declared by the authorities in the country, or in the territory of the insurance contract. Advertising: Therefore, in the connection with military risks, today there is no classical coverage of relevant insurance payments for ships that follow to the northwestern part of the Black Sea. The stable operation of maritime logistics requires the confidence of shipowners and foreign partners in the maximum guarantee of transportation safety and receiving compensation from the state in case of damage due to armed aggression of the Russian Federation at sea. The project proposes to establish in 2025 a mechanism for providing guarantees of compensation for damage to operators in the event of such damage occurring from January 1, 2025, during the stay of vessels in the territorial sea of Ukraine, within the limits of the temporary sea route and in the water areas of open sea ports (if they entered such ports after January 1, 2024), provided that the vessels transport non-military cargo to (from) such ports of Ukraine. Advertisement: It is emphasized that according to Article 35 of the Law of Ukraine “On the State Budget of Ukraine for 2025” guarantees of compensation for damage can be provided in the amount of up to UAH 2 billion at the expense of the reserve fund of the state budget.
