The Court of General Jurisdiction of the EU decided to cancel the fine in the amount of 1.49 billion euros.

The case dates back to 2019, when the European Commission said Google abused its dominant market position for a product called AdSense for search. Then the European Commission fined the tech giant 1.49 billion euros, and Google appealed this decision in response.

The European Commission alleged that Google abused its market dominance by imposing a number of restrictive clauses in contracts with third-party websites, which ultimately prevented competitors from placing their ads in search on those websites.

The Court of General Jurisdiction of the EU issued a decision supporting most of the conclusions of the European Commission, but overturning the decision by which the European Commission imposed a fine.

The court added that the European Commission did not take into account all the relevant circumstances when assessing the duration of the contract provisions that it considered abusive.

Currently, the European Commission, if it decides, can appeal today’s court decision to the highest instance – the European Court.
