The Supreme Court upheld the legality of the decision of the Northern Court of Appeal at the request of the Kyiv prosecutor’s office and decided to return the coastal area on Lake Vyrlytsia in the capital’s Darnytsia district to communal ownership.
It is noted that the area of the plot is almost 20 hectares, and its value was estimated at more than 1 billion. Since 1994, the plot of land near Lake Vyrlytsia has been reserved as a valuable natural area with significant recreational value.
The claims were based on the fact that the disputed plot of land belongs to the lands of the water fund and the coastal protection strip and cannot be built on. At the beginning of 2023, the Commercial Court of Kyiv rejected the prosecution’s claim, but the appeals court fully agreed with the prosecutor’s arguments.
According to his resolution, the decision of the Kyiv City Council was declared illegal, the lease agreement was invalid. The tenant must vacate the land plot.
