The commercial court of the city of Kyiv levied a fine of UAH 5.65 million on “BK KBR” LLC for the supply of low-quality protective vests, hard hats and helmets to the Department of Defense Work and Cooperation with Law Enforcement Bodies of the Volyn Oblast.

About this testifies court decision dated October 28.

In March 2022, the Department for Defense Work and Cooperation with Law Enforcement Bodies of the Volyn Regional State (Military) Administration ordered 650 protective vests and 650 helmets for the total amount of UAH 24.86 million from “BK KBR” LLC.

A few days later, the parties concluded another agreement on the supply of 196 combat helmets, 150 Kevlar helmets and 150 protective vests for UAH 9.06 million. Later, changes were made to this contract and it was already about 234 protective vests and 196 combat helmets for UAH 9.04 million.

Later, the customer paid for the goods and handed them over to the military unit, the number of which is hidden in the Court Register.

According to the conclusions of forensic-economic and forensic-commodity examinations, the bulletproof vests under both contracts do not correspond to the IV-VI class of protection, as stipulated in the agreements, and do not have markings.

In addition, combat helmets do not correspond to the I class of protection and also do not have markings. Helm bojowy WZ.2005 helmets produced by the Polish company Makspol SA do not meet the first class of protection (they do not perform the main function – they do not protect the human head from being hit by metal elements of firearms).

The prosecutor’s office appealed to the court with a demand to collect a fine of UAH 4.14 million from the supplier for the first contract and UAH 1.51 million for the second.

The court agreed that “BC CBR” LLC delivered goods of inadequate quality, and ordered the company to be fined a total of UAH 5.65 million.

Dmytro Nesteruk is the owner of the capital LLC “BK KBR”, the manager is Maksym Vyshnyakov.
