Reservation from April 1: what businesses and those liable for military service need to know

In February, the Cabinet of Ministers extended the deadline for re-reservation of conscripted employees to March 31 due to cyberattacks on state registers. Enterprises received additional time to confirm the status of critical and re-reserve personnel. UNN tells you what companies and conscripted employees need to know. 

In response to a request from UNN, the Ministry of Economy reported that the definition of an enterprise, institution, or organization as critical to the functioning of the economy and ensuring the vital needs of the population in a special period is carried out by the central executive body, another state body, a state administration body whose jurisdiction extends to the entire territory of Ukraine, in the relevant area of management and branch of the national economy, or by the regional, Kyiv and Sevastopol city state administrations (military administrations in the event of their formation) in the territory of the relevant administrative-territorial unit. 

The ministry emphasized that in order to recognize an enterprise as critical, it must meet at least three criteria: 

• the total amount of taxes, fees, payments to the state and local budgets, excluding customs payments, and the amount of single contribution to compulsory state social insurance for the reporting tax year exceeds the equivalent of 1.5 million euros; 
• the amount of foreign currency inflows, excluding loans, for the reporting tax year exceeds the equivalent of 32 million euros;
• the enterprise, institution, organization is of strategic importance for the economy and security of the state (a detailed list can be found at link); 
• the enterprise, institution, organization is of great importance for the branch of the national economy or for ensuring the needs of the territorial community (determined by local authorities);
• no arrears in tax payments to state and local budgets;
• the enterprise, institution, organization is a resident of Diia City;
• the average salary must be at least 20 thousand hryvnias for the reporting period.

The ministry said that the procedure for reserving conscripts for the period of mobilization and for wartime, approved by the relevant government decree, remains in force after March 31. 

Resolution No. 208 establishes that deferrals from military service during mobilization, which were granted to conscripts by decisions of the Ministry of Economy, or by means of the Unified State Web Portal of Electronic Services (“Diia”) and the validity of which did not expire on the date of entry into force of this resolution, are valid until March 31. 

“At the same time, deferrals from military service during mobilization, which were granted to conscripts, lose their validity after March 31, if the enterprise, institution, organization has not confirmed the status of critical or has not been identified as critical for the functioning of the economy and ensuring the vital needs of the population in a special period by March 31,” the ministry adds.

At the same time, the Ministry of Economy reported that information on the number of enterprises that have updated the status of critical is classified as restricted and cannot be provided. 

Important. The Cabinet of Ministers’ decision to extend the deadline for re-reservation of conscripted employees until March 31 was made due to an attack on state registers, so enterprises have asked for a simplified re-reservation. The standard reservation period in “Diia” is 72 hours for transferring reserved employees to special military registration. On January 18, “fast reservation” was introduced for critical enterprises, that is, without taking these terms into account. From April 1, when booking, the standard term will be 72 hours, during which employees will not have a deferral in case of re-reservation.

Without taking this period into account, those reserved in state bodies, the National Police, NABU, SBI, prosecutor’s offices, BEB, SES, the criminal executive service, the Court Security Service, courts, institutions of the justice system, pre-trial investigation bodies, in full-time positions of patronage services will be transferred to special registration.
