Defense argues that investigators have misinterpreted the message on Telegram, removed from the phone of another suspect – Alexei Pertsev. In particular, government experts allegedly did not indicate that one of the messages was sent and attributed to his authorship of a storm, although in fact it belonged to the journalist. According to protection, it could have affected the jury.
On Friday, the government acknowledged that in December 2024 only the defense party was a full version of the chat with sent messages, although earlier reported this in September 2023. Storm representatives stressed that this failure is part of the wider problems with the evidence base. In particular, Telegram files do not have metadata about the authors, which undermines the accuracy and admissibility as evidence.
The prosecutor’s office insists that the version of the chat, which it will use in court, was obtained by the US Tax Management agent directly from the device and was transferred in December. According to the government, the problem with formatting does not affect the authenticity of the evidence, and the protection had enough time to analyze.
Storm also urged the community to assist with an additional $ 500,000 fees – the cost of court proceedings exceeded the initial valuation ($ 2 million) due to the complexity of legal arguments and the emergence of new witnesses and evidence. The process will probably last up to four weeks.
