PFU demands to collect illegally paid pension funds from the citizen in the amount of 75,209 hryvnias

The man’s disability pension was temporarily suspended. The Pension Fund requests the return of the erroneously transferred pension in the amount of 75,209 hryvnias. This is stated in the ruling of the Saltiv District Court of the city of Kharkiv, published on November 5, 2025.

The citizen is registered and receives a II group disability pension from March 20, 2024, appointed in accordance with Law No. 1058 “On mandatory state pension insurance” on the basis of an application dated April 9, 2024 for No. 4810, an extract from the review report of the medical and social expert commission dated March 20, 2024, issued interdistrict Slobid medical and social expert commission of Kharkiv. Subsequently, the payment of the pension was suspended in accordance with the decision of the Pension Recalculation Department No. 2 of the State University of PFU in the Kharkiv Region dated 13.02.2025, adopted on the basis of the certificate of the KZOZ “Regional Center for Medical and Social Expertise” of the Kharkiv Regional State Administration No. 64 dated 26.12.2024 on not recognizing him as a person with a disability from 20.03.2024 year In a letter dated March 14, 2025, the State Administration of PFU in the Kharkiv region informed the citizen about the suspension of the payment of the pension on the above grounds and offered to compensate the overpaid pension in the amount of 75,209 hryvnias. However, the indicated funds were not returned by him.

What was the decision of the court? The court satisfied the claim of the Main Department of the Pension Fund of Ukraine in the Kharkiv region. An excessively paid pension in the amount of 75,209 hryvnias will be withheld from the citizen for the benefit of the PFU.

“Therefore, the return of overpaid pension amounts involves reimbursement of the specified amounts only when such overpayment occurred due to the fault of the pensioner, namely due to abuse, in particular, in the case of providing false information. Based on the documents provided by the plaintiff, the court established that the defendant has no right to grant a pension since March 20, 2024, i.e., from the moment of its appointment. As a result, the defendant was unreasonably charged and a disability pension of the II group was paid from 20.03.2024 to 31.01.2025 in the amount of 75,209 hryvnias. During the trial, the defendant did not exercise his procedural rights and did not respond to the claim. Thus, the defendant did not refute the arguments of the plaintiff regarding the groundless establishment of the II disability group and the appointment of a pension, in particular, based on the documents contain unreliable data. Under such conditions, the court reached a conclusion about the validity of the claims and their satisfaction in full,” the court emphasized.
