The National Bank of Ukraine denied the possibility of providing uncontrolled and unlimited extrajudicial access to banking secrets.

“The National Bank denies the provision of uncontrolled and unlimited extrajudicial access to bank secrets for any body. According to the court’s decision, law enforcement and tax authorities can gain access to information containing bank secrets, but for this they need to provide evidence of reasonableness, expediency and the existence of grounds obtaining such information, which is an important safeguard for limiting the access of controlling bodies to private information about a person,” the NBU said in a message on Facebook.

The regulator reminded that unjustified expansion of access to banking information endangers the fundamental rights of citizens and contradicts European values.

“The importance of the institution of bank secrecy is no less important than the principle of the presumption of innocence defined in the Constitution, which is the foundation of trust in society,” said the head of the National Bank, Andrii Pishniy.

Banking secrecy in Ukraine – the latest newsOn December 4, 2024, the co-founder of Monobank, Oleg Horokhovskyi, stated that when issuing a “National Cashback” card in “PrivatBank”, clients automatically give permission to disclose bank secrecy. Moreover, in the clause of PrivatBank’s contract with clients, referred to by Horokhovsky, it is stated that the data is transferred “for all current current accounts with the issuance of a Payment card, and in particular for current accounts with the issuance of a Payment card that may be opened by the Client in the future.”

People’s deputy Yaroslav Zheleznyak noted that this part of the requirement applies not only to “PrivatBank”, but also to all other banks – in the Procedure approved by the Cabinet of Ministers of Ukraine.

Later, “PrivatBank” stated that they act exclusively within the framework of the legislation, transferring information about client transactions for the purpose of calculating “national cashback”.
