Since 2018, NABU has been investigating in criminal proceedings on the facts of unlawful receipt by a number of people’s deputies of monetary compensation for renting housing in Kiev during the performance of their deputy powers.
According to the SAP prosecutor in October 2024, within the framework of this criminal proceedings, NABU detectives were notified of suspicion under Part 2 of Art. 364 of the Criminal Code of Ukraine former People’s Deputy Vadim Nesterenko.
Last Wednesday (12.02.2025) investigation turned to WACS with a request for election against Vadim Nesterenko a pre -trial detention measure.
During the court hearing, 17.02.2025, the lawyers of the defense gave the court indisputable facts regarding the attempts of extraprocessal influence and the reference of the prosecution party to the suspect.
In particular, it turned out that in October 2024, shortly after the suspicion was made, a lawyer contacted him, who suggested his professional assistance in defending Nesterenko in this case.
As it turned out, this lawyer is actually related to NABU staff, who systematically provoke bribes against different officials.
In particular, Nesterenko was proposed to participate in the provocation of Vitaliy Klitschko’s bribe. In exchange for this, the lawyer guaranteed that NABU and the SAP would not raise the issue of election of a non -tertiary measure and agree to retraining.
At the same time, prosecutors and detectives themselves suggested that the suspect of Nesterenko find the opportunity to transfer a bribe at his own discretion. However, Nesterenko himself was not in relation to the nickname and had no such opportunity.
In order to confirm the said statements, Nesterenko’s defense party at the court session on 17.02.2025 provided a personal statement of Vadim Nesterenko on the relevant circumstances and screenshots of correspondence with the appropriate lawyer.
Among other correspondence materials, a photocopy of NABU signed by NABU Ivan Dyachuk and the SAP Prosecutor Artem Stelmakh was a request for a non -existence of a preventive measure that was sent Vadim Nesterenko in early December 2024 – that is, more than two months before his submission.
Thus, these facts unconditionally indicate that the request for the election of a preventive measure from December 2024 was used NABU and SAP to execute extraprocessal pressure on Nesterenko, and appeal to the court only in the mid -February this year testifies to discontent With Vadim Nesterenko.
