The US court rejected the request of the Brothers Anton and James Perir-Beno to close their $ 25 million fraud case using MEVbots.
In court documents It is noted that in May 2024 the brothers used vulnerability in Ethereum to steal cryptocurrency from traders through the manipulation of MEV bots.
Judge Jessica Clark has decided that the government had sufficiently argued – despite the technical novelty, the actions of the persons involved in the law on fraud.
MEV (Maximal Extractable Value) Bots are commonly used for frontranging – that is, priority execution of transactions with higher commissions. They also look for profitable arbitration in the mempul.
The chieftain was developed and implemented a unique four-stage strategy: “bait, lock, search, distribution”. To do this, they launched 16 validators in Ethereum and used 529.5 ETH.
The defense argued that the actions of the brothers were allowed by the network code, so they were not regarded as a crime. In addition, they indicated that the MEV-bots themselves acted manipulatively and did not deserve protection.
Nevertheless, the court disagreed with arguments. Separate accusations of conspiracy to obtain stolen property were removed after the defendants referred to the internal document of the Ministry of Justice to avoid excessive regulation of digital assets.
The trial of the brothers was scheduled for October 2025. They will be responsible for charges of fraud, collusion for fraud and money laundering.
Recall that in June, the Flashbots Research Group said Maximal Extractable Value (MEV) is a key barrier to cryptomane scale.
