“The court chose a preventive measure for the anti-corruption activist and founder of the “StateWatch” analytical center, Oleksandr Lemenov, who is accused of evading duty and failing to appear on a summons to the TCC. He was granted bail…”, — write: www.unian.ua
In particular, it states that Lemenov has a military specialty “organization of the moral and psychological support of the troops” and in February 2024 the VLK recognized him as fit for military service, writes “Law and Business”.
But since November, Lemenov avoided visiting the Bilotserkiv TCC, where he is registered, and as a result, he was declared wanted. During the pre-trial investigation, he also did not appear before the investigator, which “testifies to his improper procedural behavior,” the decision noted.
And on December 6, when he arrived at the TCC, he was read a summons about the need to come to the assembly point and warned of criminal liability for evading the draft. However, in the presence of witnesses, Lemenov refused to receive the summons and did not appear at the assembly point at the appointed time, and did not report the reasons for his non-appearance.
Already on December 8, Lemienov was informed of the suspicion of committing a criminal offense under Article 336 of the Criminal Code, which provides for up to 5 years of imprisonment.
“O.V. Lemenov, knowing reliably about the state of war on the territory of Ukraine, without any remorse or sympathy committed a criminal offense in the field of ensuring conscription and mobilization,” the investigating judge noted, choosing a preventive measure.
The court also questioned witnesses who confirmed the circumstances provided to the investigators.
60.5 thousand Lemenov must deposit the hryvnia deposit into the court’s deposit account within 5 days. The court also obliged him to appear at the first summons to the investigator, the prosecutor, the investigating judge, the court and inform them about the change of his place of residence.
We will remind that this is not the first case when anti-corruption activists avoid military service. This phenomenon has already been called “shabuning” – after the surname of Vitaliy Shabunin, the head of the Anti-Corruption Center, against whom the SBI initiated a number of criminal cases, in particular, on evasion of mobilization, forgery of NAKC documents, illegal use of a humanitarian vehicle and appropriation of a Nissan Pathfinder jeep.
According to the media, many anti-corruption activists and activists are evading the army, including the husband of the head of the Communist Party of Ukraine Daria Kaleniuk Orest Rudy, Mykhailo Zhernakov, journalists Yuriy Butusov, Yuriy Nikolov, Maksym Savchuk, Maksym Opanasenko, Oleksandr Notevskyi, Oleksiy, the son of Petro Poroshenko, and his lawyer Igor Golovan and others.
