The Pension Fund requires a man to recover a pension of 20 930 UAH because he resumed police services
The man was registered in the Pension Fund and received a pension for years of service. He was subsequently renewed and stopped by a pension, so he should return the overpayment of UAH 20,930. This is stated in the decision of the Darnytsky District Court of Kyiv, published on September 29, 2025.
The man who received a pension for years of service in accordance with the Law on the Pension Support of Persons Dismissed from Military Service and some other persons was registered in the Main Directorate of the Pension Fund of Ukraine in Kyiv in Kyiv. According to an excerpt from the order of the Strategic Investigation Department of the NPS of May 31, 2023, it was renewed to service from June 1, 2023. Taking into account the State PFU, from July 1, 2023, the PFU stopped paying a pension from July 1, 2023, which formed a pension overpayment for the period from June 1, 2023 to June 30, 2023 in the amount of UAH 20,930. In June 2024, he returned part of 5 thousand hryvnias voluntarily, but the balance of overpayment is UAH 15,930. Thus, the PFU asks the court to recover the funds from it.
Consideration of the case The court found that a man who received a pension in accordance with the Law of Ukraine “On Pension Support of Persons Dismissed from Military Service and Some Other Persons” was registered in the Main Directorate of the Pension Fund of Ukraine in Kyiv. According to the excerpt from the order of the Department of Strategic Investigations of the National Police of Ukraine of May 31, 2023, he was renewed to service from June 1, 2023. Considering the above, the Main Directorate of the Pension Fund of Ukraine in Kyiv, since July 1, 2023, stopped payment of a pension in accordance with the provisions of the Law on Pension Support of Persons Dismissed from Military Service and some other persons. In this regard, a pension was formed for the period from June 1, 2023 to June 30, 2023 in the amount of UAH 20,930. In June 2024, part of the funds in the amount of 5 thousand hryvnias was voluntarily entered into the account of the Main Directorate of the Pension Fund of Ukraine in Kyiv. The overpayment balance is 15 930 UAH. In order to resolve the issue of reimbursement of excess paid funds to the citizen, a letter was sent to voluntarily pay over the funds. As of the day of appeal to the court, the extra -paid funds did not repay.
What was the court decision? The court satisfied the claim of the Main Directorate of the Pension Fund of Ukraine in Kyiv. The man in favor of PFU will be unjustifiably received in the amount of UAH 15,930.
“Taking into account the circumstances and the evidence provided by the plaintiff, given the fact that the defendant had not been submitted to the claims regarding the claim, the court concluded that the claims were subject to satisfaction,” the court stressed.
