The woman was accrued social payments on children Under the tutelage from 01.09.2020 to 30.06.2021 in the amount of 5 987 UAH, and from 01.07.2021 to 31.08.2021 – 6 275 UAH on a monthly basis. Because of this, from 01.09.2021 to 28.02.2022, a overpayment totaling UAH 43 650 was formed. This information is listed in the decision of the Podilsky District Court of Kyiv of December 23, 2024.
On the basis of the appeal of September 25, 2020, citizens approved monthly payments for children under care. However, for the period from 01.09.2021 to 28.02.2022, she was transferred 43 650 UAH in excess of the established norms, of which 37 650 hryvnias – excessive assistance, and 6,000 hryvnias – extra money of targeted social support. The woman ignored the message about the need to return money by 10.10.2024.
The course of the trial The court found that the decision of the Podilsky Court of Kyiv of June 23, 2016 (Case No. 758/1576/16-C) was deprived of parental rights regarding the daughter, which was transferred to the guardianship authorities. At the order №540 of 26.08.2016 the child was granted the status of deprived parental care, and by order №541 enshrined the guardian of the grandmother.
On September 25, 20120, the guardian applied for social payments. According to the Law of Ukraine “On Help for Care”, from 02.10.2020 she was assigned a monthly assistance of 5 795 UAH from 01.09.2020 to 08/31/2021.
Court decision The court satisfied the claim. 37 650 UAH of excessively accrued assistance for the period from 01.09.2021 to 28.08.2022 and 6 000 hryvnias of extra payments (in accordance with letter # 12/424-10 dated 23.04.2024) in favor of the Social and Veteransky Policy Department of the Podilskyi district was collected from the woman.
“The court acknowledged that since the defendant did not return the excess funds voluntarily, the claim should be fully satisfied,” the decision said.
