A coalition of American lobbying and educational cryptogroups sued Amicus Brief in support of Michael Levellelen’s developer who created a non -Costodial Defi protocol and planned to publish the code. He was accused of violating the laws on money transfers.

The signatories include Paradigm, Defi Education Fund, Blockchain Association and Crypto Council for Innovation.

According to the authors, the Ministry of Justice abuses Article 1960 of Section 18 of the US Code, developed to combat unregistered money transfers.

According to an appeal, liability under this article provides for participation in the “money transfer” defined as “transfer of funds on behalf of [іншої особи] in any way. ” The authors of the letter emphasize that it is impossible to delegate funds without being stored.

The government’s approach was compared with the pursuit of the manufacturer of the frying pan for dishes that are prepared by third parties.

“The new false and excessively wide interpretation of Article 1960 on the prosecution of non-disascakes, which allows people to carry out P2P transaction, restrains innovation,” the document said.

The authors emphasize that the legal uncertainty and pressure from the Ministry of Justice deter developers of decentralized financial. Businesses will choose between termination and departure to other jurisdictions.

Coalition participants urge the court to allow Levellen’s case to continue to make a declarative decision and clarify the legal status of development of open cryptocurrency software in the United States.

The lawsuit also touches on Tornado Cash, in which the Ministry of Justice uses the same legal norm to prosecute developers.

We will remind, on July 7, the Bud closed the case of Coin Center and the Ministry of Finance on sanctions against Tornado Cash.
