Walt Disney and Universal (COMCAST) filed a lawsuit with the Los Angeles Federal Court against Midjourney with charges of use intellectual property without permission.
The plaintiffs are called the popular image generator based on the “bottomless pit of plagiarism”. According to them, the Midjourney pirate copied the libraries of Hollywood studies and created “many” images of heroes such as Dart Vader of “Star Wars”, Els from “Ice Heart” or Minyons from “worthless I”.
“We believe in the potential of AI and see in it a tool for the development of human creativity. But piracy remains piracy-regardless of whether it is carried out by the Shi Company, ”said Vice president and Chief Legal Counsel of Disney Orasio Gutiereres.
The US Film Industry Association (MPA) has supported the claim, stressed that companies in the field of AI should respect copyright.

The claim states that the studios have applied to Midjourney to stop the use of protected works or at least introduce technical restrictions on characters generation. However, instead, the company continued to produce new versions of its generator with even better images.
Midjourney allows you to create images based on text queries. Among the examples provided in the lawsuit: Yoda with a light sword, Bart Simpson on skateboard, an iron man above clouds, Lyter Basz in flight, as well as Universal characters-toothless from “How to Taming a Dragon”, with “Kung Fu Panda” and Shrek.
Disney and Universal require a temporary ban on the use of their works as well as compensation for losses. They claim that the SI company has used their work to study the AI, which generates copies of protected characters. According to the plaintiffs, a company founded by David Kholts in 2021 earned $ 300 million on paid subscriptions only last year.
The claim states that Midjourney “behaves as a classic freeider and demonstrates system plagiarism” without investing “a single penny” in the creation of original materials.

In 2022, in an interview with Forbes, David Holtz acknowledged that the Midjourney database was created by “mass scrapeting of the Internet”.
