On March 24, President of Ukraine Volodymyr Zelensky signed European integration law No. 12368-1, which provides for the creation of two new judicial bodies-a specialized district administrative court and a specialized administrative court of appeal.
This step is part of Ukraine’s obligations to the European Union and the International Monetary Fund.
According to the law, the High Qualifications Commission of Judges of Ukraine should announce a competition for the post of judges in these courts within a month after the document came into force. An expert council will be created to ensure the transparency of the process to check the candidates for compliance with the criteria of integrity and professional competence.
The Verkhovna Rada adopted this Law on February 26, receiving the support of 234 MPs. The law formally complies with EU and IMF requirements, but experts from the NGO “Center for Combating Corruption” have expressed concern about some norms.
According to them, these provisions can allow the authorities to influence the appointment of judges and decisions of the appeal.
The Ambassadors of the Great Seven (G7) positively evaluated the adoption of the law, emphasizing the importance of its implementation to strengthen the rule of law in Ukraine.
At the same time, public organizations call for increased control over the process of forming new courts in order to avoid the risks of political influence.
We will remind, the Pechersk District Court of Kiev decided to continue the measure of restraint for Nestor Shufrych, the People’s Deputy of Ukraine, until May 18.
