Today, September 16, the panel of judges of the High Anti-Corruption Court passed a verdict against two participants in the case related to violations during the provision of housing for military personnel.
As the press service of VACS reports, the former director of the Department of Capital Construction of the Ministry of Defense and the former director of a private company were found guilty of official forgery (Part 1 of Article 366 of the Criminal Code of Ukraine as amended on May 13, 2014).
Both were sentenced to three years’ imprisonment with deprivation of the right to hold positions related to organizational-management or administrative-economic functions for a period of three years. At the same time, in accordance with Clause 2, Part 1, Art. 49 and Part 5 of Art. 74 of the Criminal Code, persons were released from serving their sentences.
At the same time, the court found the former official of the Ministry of Defense innocent of the charge of embezzlement of property in particularly large amounts (Part 5 of Article 191 of the Criminal Code) due to the lack of a crime. A similar decision was made regarding the ex-director of the company, who was accused of complicity in embezzlement (Part 5 of Article 27, Part 5 of Article 191 of the Criminal Code).
In addition, the court refused to satisfy the civil suit of the Ministry of Defense of Ukraine to recover material damages from the defendants.
The verdict can be challenged in the appeal procedure within 30 days from the day of its announcement.
