He was arrested on suspicion of providing false data in US immigration documents. According to the investigation, in October 2023, he applied for temporary protection (Tempory Protected Status), noting that there were no criminal proceedings against him either in Ukraine or abroad.
In fact, US prosecutors found that at that time Gorbunenko was already involved in a large -scale case about the creation of a criminal organization and the seizure of hundreds of millions of public funds in Ukraine. The US Federal Prosecutor’s Office is charging him with false information (18 USC § 1546 (a)), for which up to 15 years in prison and a fine of up to $ 250,000.
In Ukraine, Gorbunenko appears in the high -profile proceedings of NABU and SAP, open in March 2020. The investigation claims that in 2019-2021 a group of high -ranking officials and businessmen organized a corruption scheme, causing damage to hundreds of millions of hryvnias. According to the investigation, it includes the former head of the State Property Fund Dmitry Sennychenko, Andriy Gmirin, Pavel Prysyazhnyuk, Mykola Presentiev, Arthur Somov, Vladimir Kolot and Gorbunenko.
One of the directions of the scheme is related to the Odessa port plant: “Agro Gas Trading” supplied gas to the plant within the Delivery Scheme, and the actual profit remained with a private company. In 2020, the plant suffered more than UAH 1.2 billion in losses, while the company could receive tens of millions of dollars.
Another direction is the sale of an illmenite concentrate through a combined mining chemical company at low prices through an affiliate Czech company, some of the raw materials were resold at market prices in the Russian Federation and occupied Crimea. The state lost at least UAH 118 million.
In general, NABU and SAP are suspected of grouping participants in the legalization of criminal proceeds in the amount of more than UAH 10 billion. It is Gorbunenko that hiding his role in the case by submitting documents for residence in the United States that became the basis for his arrest in Florida.
Now he is threatened not only by the Ukrainian investigation, but also by the strict sanctions of the US court. If guilty is proved, it can be up to 15 years in the US lattice, not counting the case of billions of theft in Ukraine.
