The Supreme Court completes consideration of Poroshenko’s lawsuit regarding sanctions

The trial in the Cassation Administrative Chamber of the Supreme Court on Petro Poroshenko’s claim to cancel the sanctions introduced by the decree of the President of Ukraine is entering its final stage.

According to lawyer Ihor Golovan, the court has already examined most of the materials, and only a few dozen pages remain to be considered. Lawyer Ilya Novikov expects that a decision can be made at the beginning of next year.

Petro Poroshenko, as the author of the Law of Ukraine “On Sanctions”, insists that restrictive measures cannot be applied to citizens of Ukraine who are in state-controlled territory.

The court examined the transcript of the meeting of the Verkhovna Rada during the adoption of this law, which, according to the plaintiff, confirms this interpretation.

Poroshenko believes that the sanctions against him as a citizen of Ukraine are a gross violation of the Constitution and the principle of the rule of law.

The politician emphasizes that the law directly defines the range of subjects to which sanctions may be applied: foreign states, foreign legal entities, legal entities under the control of foreign structures, as well as non-resident natural persons, foreigners and stateless persons.

According to him, even in the case of persons who are permanently in the occupied territory, the Security Service of Ukraine should prove their status as non-residents and the high risk of acquiring citizenship of another state.

He calls the application of sanctions against a citizen of Ukraine “an extrajudicial, illegal and unconstitutional action” by the current president.

Ihor Golovan emphasized that the introduction of sanctions against Poroshenko harmed not only his rights, but also the international authority of Ukraine and the practical help that the leader of “European Solidarity” provides to the Armed Forces.

In his opinion, the sanctions decree should be canceled as it contradicts the Constitution and the principle of the rule of law.

Golovan warns that ignoring this principle threatens Ukraine’s European perspective, because the rule of law is one of the key requirements for joining the EU.

We will remind you that Poroshenko believes that Svyridenko was awarded the premiership for the sanctions against him.

Poroshenko also declared a donation of a million dollars in Turkey, gave it to children.
