The State Bureau of Investigation (SBI) completed a pre-trial investigation into the case of inadequate defense of the Kharkiv region during the offensive of Russian troops in May 2024.

On January 7, 2026, the defense was officially notified of the end of investigative actions and access to materials was opened in accordance with Art. 290 of the CPC of Ukraine.
The defense side has started reviewing the materials collected during the pre-trial investigation. Their volume is estimated at approximately 300 volumes of written documents.
The investigation accuses the military command of negligent attitude towards military service (Part 4 of Article 425 of the Criminal Code of Ukraine) and failure to comply with an order (Part 3 of Article 403 of the Criminal Code of Ukraine).
“This case is a precedent for Ukrainian justice, as it raises the question of the limits of responsibility of the military command for the decisions made in the conditions of the prevailing enemy forces and the systemic lack of human and material resources,” the defense side noted.
NABU opened the case through possible corruption of former SBU officials.
NABU and SAP submitted to the court the case of ex-minister Solsky regarding land appropriation.
Tymoshenko will turn to her colleagues and friends if the appeal does not overturn the decision of the VACS on bail.
