The preventive measure was chosen in the Pechersk court
In Pechersk Court of Kyiv, December 18 chose preventive measure for suspects in the brutal murder of 21-year-old Danylo. It is about the 45-year-old former employee of the Odesa Customs Service, Oleksandr Agoev, and the 19-year-old Bohdan Rynzhuk, the son of a well-known businessman in Bukovina, the ex-director of the Kaliniv market, Ivan Rynzhuk, and the stepson of Olesya Ilashchuk, the current ambassador of Ukraine to Bulgaria. Criminals tortured Danilo for four hours in order to gain access to a cryptocurrency wallet.
The attackers take turns entering the containment box. They are tried separately. Despite the fact that the case gained international publicity, and photos of the suspects are easily found on the Internet, both defendants tried to hide their appearance from journalists as much as possible. Agoev practically “grew” into the bench, bowing his head low in his hood. Bohdan Rynzhuk covered his face with a buff, leaving only a narrow slit for his eyes.
Murder in Vienna
As noted by the prosecutor of the General Prosecutor’s Office, the defendants carefully were preparing to the crime: they looked for a place in advance, bought gasoline, and after the murder already on November 26, they crossed the border and returned to Ukraine.
Bohdan Rynzhuk was friends with the deceased’s brother, Volodymyr Kuzmin. Under a fictitious pretext, he arranged a meeting with Danylo Kuzmin. The meeting was arranged at the Sofitel hotel (Vienna).
In the evening, Rynzhuk met with Danylo, they went down to the underground parking lot of the hotel. And Oleksandr Agoev was waiting for them there. Accomplices blocked the door on the landing so that Danylo could not escape, they beat the boy until he stopped resisting. In a semi-conscious state, he was thrown into the back seat of his Mercedes. Agoev got behind the wheel, the car left the parking lot. Together, the perpetrators forced Kuzmin to transfer 50,000 euros from his cryptocurrency wallet to an account that is currently being established by the investigation.
Therefore, they bought a canister of gasoline at the gas station. The car was parked under a bridge in the Donaustadt area, doused with gasoline and set on fire. The owner was still alive inside at the time of the fire. Possible cause of Danylo’s death: thermal shock or suffocation.
The Austrian side is official confirmed coincidence between the missing citizen of Ukraine and the body found in a burned-out car, and passed the relevant information to Ukrainian colleagues within the framework of international police cooperation.
As a result of operational measures, the National Police of Ukraine detained both suspects in Odesa. During the searches of the hotel room, apartment and car, cash in foreign and national currency, mobile phones, clothes and other items that may have evidential value were seized. All materials are submitted for expert research.
On December 16, Ukrainian investigators reclassified the case under Part 2 of Art. 115 of the Criminal Code of Ukraine – intentional murder committed under aggravating circumstances.
The Pechersk District Court of Kyiv ordered both defendants to be remanded in custody until February 15 next year. The prosecutor also stated that the investigation is checking the possible involvement of other persons in the crime.
The resonance of the case increased the status of the family of the deceased. Serhiy Kuzmin holds the position of deputy mayor of Kharkiv and is responsible for the digital transformation of the city. In his declarations the specified significant assets are real estate in Kyiv, dozens of plots of land near the capital and four premium class cars.
Innocent – say the lawyers
At the same time, the defense side insists on the innocence of one of the suspects. Oleksandr Agoev’s lawyer, Oleksiy Glazov, at the beginning of the court session managed to hold it “behind closed doors” in the part where his client was to testify:
“The murder of Kuzmin took place under very mysterious circumstances. It may happen that the position of the suspect may expose the actions of certain persons,” said lawyer Glazov and added that they did not prepare a request for a closed session, as they did not expect that there would be so many media representatives in the hall.
According to the lawyer, the announced suspicion against Agoyev is unfounded, and the preventive measure in the form of detention is excessively harsh. “We believe that at least the court should determine the size of the bail,” the defense attorney said.
Agoev himself denies his involvement in the crime. “He did not kill,” emphasized the lawyer.
At the same time, the law enforcement agencies incriminate Agoeva and Ryzhova, Part 2 of Art. 115 of the Criminal Code of Ukraine is intentional murder, punishable by imprisonment for a term of 10 to 15 years or life imprisonment.
