The Ministry of Defense of Ukraine introduced stricter criteria for executors of defense contracts who have debts in enforcement proceedings and against whom enforcement actions are suspended during martial law.

In particular, the volume of production of goods, execution of works and provision of defense services must exceed 50% of the total volume of enterprise activity for the last reporting period. This innovation is determined by the Cabinet of Ministers resolution “On the procedure for determining the enterprises of the defense-industrial complex that are debtors in executive proceedings.”
The Ministry of Defense received the relevant powers after the liquidation of the Ministry of Strategic Industries. According to the department, the practice of applying the previous rules showed the need for a clearer definition of enterprises for which defense production is the main activity.
From now on, the executor of a defense contract must simultaneously meet three criteria: be in the process of executing a state contract; to be included in the electronic register of participants in the selection and executors of state contracts; the volume of defense production is more than 50% of the total volume of production of the enterprise for the last reporting period.
To date, 51 companies have been added to the list of defense industry enterprises that are debtors in executive proceedings.
