Context
During the investigation within the framework of the “Midas” operation, the facts of the systematic collection of dossiers on Ukrainian investigators were revealed. The investigation established that the persons involved in the case, whose activities are connected with the Russian intelligence network, collected confidential data about Yuri Butusov’s movements, contacts and activities.
“Given that Yuriy Butusov is a military servicemanthe unauthorized collection of information about him in the interests of persons affiliated with the aggressor state creates a threat not only to privacy, but also to security,” the company said.
Previously, lawyers succeeded entering information into the Unified register of pre-trial investigations on the facts of the commission of criminal offenses provided for:
- Part 3 of Art. 171 of the Criminal Code of Ukraine (Hindering the legitimate professional activity of journalists);
- Part 1 of Art. 182 of the Criminal Code of Ukraine (Violation of privacy).
“Information in the EDPR was submitted to NABU only after the relevant court decision of January 9, 2026. However, after the investigation began, the detectives of the Bureau actually blocked Yuri Butusov’s participation in the process, ignoring the defense’s request to involve him as a victim. This deprived the applicant of procedural rights and the opportunity to control the course of the investigation,” they explained.
The lawyers challenged the inaction of the detectives in court. After reviewing the complaint materials (cases No. 760/1347/26 and No. 760/1349/26), the investigating judge found the inaction of NABU authorized persons illegal. The court obliged the Bureau to consider the merits of the defense request within 3 days of receiving the decision.
Managing partner of Sense, Dmytro Krugovy, called the situation paradoxical.
“The crime was documented by NABU itself, the dossier on the journalist and the serviceman was removed, proceedings were opened, but the investigation stubbornly “does not see” the victim in the case. Such a procedural vacuum is usually created in order to quietly bury the case without unnecessary publicity.
The court’s decision is unequivocal: it is unacceptable to ignore the rights of Yury Butusov, especially in the context of the possible surveillance of a military serviceman by Russian agents. We are waiting for the execution of the court decision and the granting of victim status to Mr. Butusov as soon as possible,” he concluded.
