The court denied the prosecutor’s office in the return of the reserve lands in Chernihiv region

The Commercial Court of Chernihiv Oblast rejected the claim of the prosecutor’s office on the return of 34.8 hectares of land of the landscape reserve “Zamglay”, which in 2020 transferred to the Ripkin settlement council. The court found insufficient evidence of the prosecution due to the lack of accurate cadastral plans of the disputed area. This is evidenced by the court decision. The Commercial Court of Chernihiv Oblast rejected the claim of the prosecutor’s office on the return of 34.8 hectares of land of the landscape reserve “Zamglay”, which in 2020 transferred to the Ripkin settlement council. The court found insufficient evidence of the prosecution due to the lack of accurate cadastral plans of the disputed area.

This is evidenced by the court decision.

The conflict arose after the State Geocadastre in the Chernihiv region transferred the local council to the land plot with cadastral number 74244455700: 02: 001: 0233 in communal property with the status of “reserve land”.

The prosecutor’s office claimed that this territory belongs to the nature reserve fund and should return to state property through the Chernihiv Regional State Administration.

We will remind, the court sent the exceltor of the Kyiv City Council Bondarenko under house arrest.

The court also left the head of Ivan Rudy in the pre -trial detention center.
