The Vozneseniv District Court of Zaporizhia passed an acquittal against a reserve officer who was charged under Article 336 of the Criminal Code of Ukraine (evasion of mobilization). The court concluded that the prosecution did not prove guilt beyond a reasonable doubt due to a number of significant violations committed by TCC employees and the police during mobilization activities.

The accused did not admit his guilt, insisting that he did not evade the draft, but demanded compliance with the law. He explained that his mobilization began with the forced delivery to the TCC and SP by the police on May 22, 2024, despite the lack of legal grounds.
The court confirmed the testimony of the accused, establishing a number of significant procedural violations:

Illegal delivery: No evidence was provided of the existence of legal grounds for the forced delivery of the man to the TCC by police officers.

Illegal retention: After serving the summons on May 23, 2024, TCC employees did not let him go home. Testimony that he “wanted to stay himself” is refuted by video recordings.

Violation of VLK: The application for repeated VLC due to hypertension and the need to provide medical documents was not properly considered by the TCC management, although during the VLC he had an unsatisfactory cardiogram, high blood pressure and poor eyesight.
The court emphasized that the prosecutor did not provide evidence of direct intent to evade. Instead, the video recorded how the man stated that he was not refusing the service, but was only asking for time for a legal VLK. According to the court, the accused was not subject to the proper legal procedure of conscription, and therefore he was acquitted.
Earlier, the Krasylivskyi District Court in Khmelnytskyi Region considered the case of a mobilization evader who cited a hangover as the reason for not appearing at the TCC, and issued a verdict.
A minibus with men of military age who wanted to flee abroad was detained in Bukovina. The court chose the driver as a preventive measure in the form of arrest with the possibility of paying a million hryvnias as bail.
