The Verkhovna Rada adopted a law on the peculiarities of regulating business activities in the transition period, which recognizes the Commercial Code as having lost its validity.
People’s deputy from the “Golos” parliamentary faction Yaroslav Zheleznyak reported this.
According to the deputy’s information, draft law No. 6013 on the peculiarities of the regulation of business activity of certain types of legal entities and their associations during the transition period was supported by 248 votes of people’s representatives.
As emphasized in the explanatory note to the draft law, the changes provided for by it are aimed at improving corporate governance in legal entities based on state and communal property, increasing the country’s investment attractiveness, introducing effective control mechanisms over the use of state and communal property objects, as well as on the elimination of contradictions between the Civil Code of Ukraine and acts of special legislation.
In particular, it is suggested that the Commercial Code of Ukraine, the provisions of which mostly do not have a regulatory effect, are declarative in their content, and also contradict other normative legal acts and general principles of civil legislation, should be declared invalid.
