The business will not pay fines due to power outages

The head of the Verkhovna Rada committee on finance, tax and customs policy, Danylo Hetmantsev, emphasized that such cases are considered force majeure and do not entail liability.

According to him, businessmen are already requesting to enshrine this in the Tax Code so as not to penalize those who could not fulfill their duties due to a power outage. “I am asking the Ministry of Finance and the State Tax Service to urgently correct, I am convinced, not intentional, distortions in law enforcement when you require taxpayers to collect all the papers in the world to confirm force majeure. Convinced, sufficient and necessary proof is the official notification of the disconnection on the official channels of energy-generating companies,” Hetmantsev said.

This means that the business does not need to run through the authorities, collecting dozens of references and documents to prove that it was unable to submit reports due to technical problems. An official notice from the power company about the power outage is sufficient, and the tax authorities do not have the right to fine.

Hetmantsev emphasized that similar norms have been in effect since the beginning of the full-scale invasion of Russia. They were introduced to ensure that entrepreneurs are not put under additional pressure in emergency situations, in particular when access to electricity or the network is limited.

Thus, government authorities should be more flexible in assessing tax violations, and businesses can operate smoothly even during power outages. This is especially true for businesses that cannot go online or store documents electronically due to temporary power outages.
