Citizens who have been declared unfit for military service in accordance with the order of the Ministry of Defense of Ukraine No. 402 may be detained at checkpoints of territorial centers of acquisition (TCC). However, representatives of the shopping center are not allowed to mobilize such persons.
As explained Lawyer Dmitry Murach on the portal of lawyers.ua, the status is not suitable according to Order No. 402, that a person, according to the results of the Military Medical Commission (VLK), is recognized as incapable of military service both in peaceful and wartime due to certain health defects. Although the presence of such status is not an automatic basis for detention, it does not exclude the possibility of stopping at the checkpoint.
The lawyer stressed that after verification of documents and status, unfit representatives of the Tax Code have no right to take any other actions related to mobilization in relation to that person.
