On June 13, Ukraine initiated the beginning of the resignation of Prime Minister Denis Shmigal-and, accordingly, the entire government. The People’s Deputy is convinced that the government has failed all areas of its activity during the war, and therefore should be released. This was already supported by other people’s deputies – in particular, the deputy chairman of the Voice faction Yaroslav Zheleznyak.
Why are the people’s deputies not satisfied with the work of the Cabinet, whether they have the chances of sending the government and how is this procedure done in general? UA.news political observer Nikita Trachuk He understood the question.
“Shmigal has to go”: what the authors of the initiative say
According to Razumkov, all work of the Cabinet of Ministers for 3.5 years of the war is actually failure. People’s Deputy points to the problem of budget deficits, lack of money for the Armed Forces, difficulties with payments to Ukrainian defenders, problems in social policy, etc. In addition, Razumkov draws attention to the fall of industrial production, tariffs and taxes, as well as “lost international policy due to the inaction of the government.”
“Now the entire Parliament to which the government is accountable should be united. There is no policy here. This is a step that will be rescue for our country without exaggeration … And if Shmigal has a drop of conscience – he has to resign on his own. It would be at least some responsible decision after everything that his team brought to the country! ” -said Razumkov in his TG channel.
To his post, the deputy added documents that show that the process has already been launched. In particular, the submission in the name of the Speaker of the Verkhovna Rada Ruslan Stefanchuk with a request to provide 200 forms on the signatures of MPs under the collective initiative for Schmigal’s resignation.
This has already been supported at least in one other faction – Voice. In particular, the People’s Deputy Yaroslav Zheleznyak in his Telegram said which completely shares the need for such steps.
“I will gladly sign a vote of distrust … I will remind that the resignation of the premiere is automatically drawn to the resignation of all ministers. And there 90% should be released for professional capacity ”, – said Zheleznyak.
However, the people’s deputy indicates a fundamental moment that may interfere with the conceived. After all, the law “On the legal regime of martial law” prohibits the termination of the Cabinet’s powers. And if Shmigal is released, then his authority, of course, will cease.
“Therefore, I will definitely take the legislative initiative to remove this from the legislation”, Zheleznyak promised.
How is the resignation of the Government on the submission of deputies
The resignation of the government at the initiative of deputies is provided by the Constitution, by law “On the Cabinet of Ministers of Ukraine” and the Regulation of the Verkhovna Rada. Under normal conditions, this process is due to the submission of a resolution of the Cabinet of Ministers, which can be made at least 150 people’s deputies. In order to make a decision, it is necessary for the resolution to vote most of the people’s deputies, that is, at least 226 people. In case of approval of the resolution, the government is obliged to resign.
The resignation of the government through the Parliament in the history of Ukraine has already occurred. In particular, in 2004, 2005 and 2010. These cases are few, but in general, the procedure is working, though not too popular.
However, in practice, in the context of martial law, the implementation of this initiative is much more complicated. The parliamentary majority, the president and the government are trying to avoid political destabilization in the executive. Instead of using resolution tools, distrust is more commonly used by point personnel solutions. Since the beginning of full -scale aggression of the Russian Federation, there was no case when the Council would have distrust the Cabinet in full.
Will the government really resign
We asked Yaroslav Zheleznyak if in his opinion there is a chance of sending Shmigal to resign – is it just about the media drawing attention to the problem of inefficiency of the Cabinet of Ministers. The deputy is positive: he believes that the initiative has every chance of success.
“Yes, I am absolutely convinced that there is a chance to liberate the government. Dmitry Razumkov is the only one who took the signature letters in advance. And even before the war. We now need 150 signatures to start the procedure and 226 votes while voting ”, – Zheleznyak said in a comment by UA.news.
However, in general, there is some skepticism regarding the success of this initiative. The unspoken “social contract” in the Ukrainian politicum during the war can be described by one phrase: “Do not loosen the boat.” The authorities are trying to maintain at least the visibility of consensus, joint work and political unity. That is why the Schmigal government, which really is issued, continues to work, and all personnel changes are precisely.
It is now unknown whether the premiere will support the majority of people’s deputies, especially from the presidential faction. The position of President Zelensky is also not obvious. It is obvious that sooner or later the entire Cabinet headed by Shmigal will resign. But the head and personally interested in this is unknown right now. And rather the answer here is “no”, and if yes, it is not exactly from the submission of opposition deputies and political opponents.
