New workers’ booking rules: what will change for business and critical infrastructure businesses

In order to implement the NSDC decision, in November last year, the Cabinet of Ministers updated the booking rules and criteria for the criticality of enterprises. From December 1, 2024, all critical enterprises had to confirm their status under new criteria. Businesses were given a transition period for re -registration by March 31. The other day, the order of reservation for critical infrastructure enterprises was also updated. That has changed in the reservation system

From April 1, he loses the reservation force, which was designed according to the old rules. The “old” reservation had to act only until February this year. But due to the hacking attacks of the Russians and the failure of the registers, the government continued the transition period for companies that did not have time to update their status critically important. This delay lasted only until March 31. Accordingly, only companies that have confirmed the status of criticality for new requirements can continue to be extended for their employees. Three of them are mandatory:

  • the average salary of employees of at least 20 thousand UAH;
  • Lack of taxes and ESAs.

The third criterion power makes it possible to choose from the following list:

  • payment of taxes and fees more than 1.5 million euros per year (equivalent in UAH);
  • currency receipts of more than € 32 million a year (except loans and loans);
  • strategic importance for the economy and security of the state (defined by the Government List);
  • Important to a particular branch of the economy or territorial community (criteria are determined by the relevant state bodies, OVA);
  • Resident status action.city;
  • supply of electronic communication services with a certain level of income.

If the enterprise has not yet updated its status, it should do it under the new procedure, and then to arrange a new booking. Pre -booking should first be canceled. Procedures are carried out exclusively in electronic format through the action portal, without any paper documents or orders. Officials promise that the term of consideration will last up to 72 hours.

At the same time, innovations are envisaged in the booking of conscripts working at critical infrastructure and defense. For them on March 28, the government agreed the following changes:

  • The booking quota for enterprises providing centralized water supply, drainage, waste management and maintaining critical infrastructure of life support systems has increased to 75%.
  • For power companies (electricity and thermal energy producers), the capacity of which is damaged or destroyed from shelling, simplified requirements for booking, namely, in the absence of tax debt and an average monthly salary of not less than 20 thousand UAH.
  • Two enterprises of the Ministry of Defense – the defense procurement agency and the state of the rear operator – have added to the list of enterprises that can book personnel.

Additional criteria

According to the Ministry of Economy, 12% of enterprises have the status of critical in Ukraine, and they have brought 67% of all enterprises in the country in 2022-2023. The department explains that they continued the transitional period so that most of these businesses manage to reform. The updated critical status will allow them to further book up to 50% of the total number of servicemen.

It is noted that the new system should remove the maximum number of jobs from the shadow, setting a higher level of official wages. This explains additional criteria for businesses that want to delay mobilization for their staff. The most controversial is the requirement for the amount of salaries of reserved.

Thus, for private enterprises, a mandatory criterion was set – the average salary in the enterprise for the last calendar quarter should be at least 2.5 minimum wage (UAH 20 thousand as of November 15, 2024). The worker who is reserved, the accrued salary should also have at least 20 thousand UAH. Explaining such requirements, Prime Minister Denis Shmigal emphasized: “This is really the principle of” fight or work. ” Either the company operates and fills the budget by paying the appropriate level of salaries and leaving the shadows, or such companies take some measures to make the salary level increased and meet the average industry. “

What with reservation for critical infrastructure

The Cabinet was forced to expand the quota for booking critical infrastructure workers after repeated performances by the industry. Until now, there was a quota of 50% of the conscripts. During three years of a full -scale war and constant mobilization, the situation with personnel at the enterprises of the industry has only deteriorated.

At the request of UA.news, the Association of Vodokanals of Ukraine replied that the government’s decision to expand the booking quota for critical infrastructure workers is “a reaction to a situation that has been alarming in the communities in recent months.”

“There are about 60,000 employees in the field of water supply and sewerage. Half of them are a woman. Men of conscript age almost 25 thousand, of which about 4 thousand were mobilized during the war. If only 50% of the booking were left, about 10 thousand men would be mobilized. In this case, the services would be practically stopped, ”the association said.

The organization explains that due to the lack of proper reservation, many experts were forced to dismiss or move to other sectors, where 100% booking is guaranteed.

“This created risks to stable provision of basic utilities, especially in the conditions of energy instability and threats to infrastructure during the war. At 50% of the prohibited conscripts, it is impossible to ensure the performance of the main functions by the enterprises of critical infrastructure. The existing shortage of qualified personnel could increase catastrophically if it was not necessary to take steps to reservate specialists, the level of knowledge and skills of which was acquired by many years of specific experience, and which mainly perform high -risk work, ”the commentary of the Association of Vodokanals said.

Representatives of water utilities also explain that new booking conditions make it possible not only to save personnel. It is also a response to the requests of territorial communities that, in martial law, are forced to maintain themselves for the supply of water, heat and waste disposal.
