The Committee for the Protection of the Rights and Guarantees of Advocacy of the National Association of Bar of Ukraine (NAAU) declared a gross violation of the professional rights of lawyer Alexander Tananakin by the online edition “Ukrainian Pravda”.
As a result of the inspection of the lawyer’s request, it was found that media representatives made an unauthorized fee and further disclosure – without the consent of the lawyer and his client – information and document obtained during the lawyer’s activity within the framework of criminal proceedings. This document was published on the official website of the publication.
NAAU stressed that such actions are contrary to Articles 22 and 23 of the Law of Ukraine “On Advocacy and Advocacy”, which prohibit the disclosure or removal of materials that make up a lawyer without the consent of the lawyer.
In addition, the Constitution of Ukraine and the current legislation guarantee the inviolability of professional activity of lawyers, as well as criminal liability for its interference (Article 397 of the Criminal Code).
The Committee prepared and sent official applications demanding to remove confidential information from public access and to initiate an objective investigation into the incident.
