The meeting in the case of Yevgeny Metzger and other persons who prevented the work of Scheme journalists in Ukreximbank were postponed to Kyiv’s Court of Appeal. The protection of journalists believes that it is a deliberate delay in the trial. Instead, Mezger’s defenders and other persons involved in the case insist that they are not satisfied with the transfer of the court.
The lawyer of one of the person involved in the case of Igor Telbizov Lyudmila Kos in a comment to UA.news correspondent. She commented on the reasons for the postponement of the meeting. According to her, the court did not take into account the document on the criminal record of its client, since it was obtained through the application “Action” in an abbreviated form.
The full extract can only be obtained physically from the Ministry of Internal Affairs at Bogomolets, 10. However, Telbizov is currently serving in the Armed Forces of Ukraine, which complicates the receipt of the necessary documents.
“As a lawyer, I sent a request to the Ministry of Internal Affairs, but I was refused to issue this certificate,” Kos said.
She also added that the defense party does not require anything new, but only insists on the closing of criminal proceedings due to the expiration of terms of prosecution.
Asked if she was satisfied with the transfer of the court hearing, the lawyer answered negatively, explaining that she did her best to provide documents.
“Now we took the appropriate extract, but the action gave it in a shortened form. We will try to get full, ”she summed up.
The lawyer of the victim Alexander Mazur Oksana Maksimenyuk expressed his indignation due to the constant delay of the trial.
“The court must check the absence of debt, as well as the fact of criminal record of the accused. Last time, he asked the parties to provide such certificates, but they were not provided with Telbizov nor the Metzger. This time, we received a certificate from Metzger, but a shortened certificate came to Telbizov, which prevents the court from making a decision, ”she said.
Maximenyuk emphasized that the delay has been going on for over two years.
“We demand that the court apply additional punishment to Mr. Mezger in the form of deprivation of the right to occupy certain positions. This was not taken into account by the court of first instance, so an appeal was filed, ”she explained.
The lawyer also stressed that the constant postponement of the case was due to numerous petitions of the accused who referred for treatment and other reasons, in connection with which the court could not make a decision within the time limits.
“This allowed the accused to file a petition for closing criminal proceedings due to the expiration of the term of prosecution. We believe that this is a deliberate strategy for delaying the process, and unfortunately the court did not respond to it, ”Maximenyuk summed up.
