Law enforcement officers opened criminal proceedings due to the voluntary abandonment of a unit by Serhii Hnezdilov, a soldier of the 56th separate motorized infantry brigade of Mariupol.

This was reported by Hromadske on Tuesday, September 24, with reference to the spokeswoman of the Kyiv Prosecutor’s Office, Nadia Maksimets.

As noted by the prosecutor’s office, the act of a serviceman has the characteristics of a criminal proceeding, provided for in Art. 408 of the Criminal Code (desertion).

During martial law, desertion is punishable by imprisonment for a term of 5 to 12 years.

Earlier, the Interfax-Ukraine agency, citing a law enforcement source, reported that the case was opened on September 23 by the Donetsk specialized prosecutor’s office in the field of defense based on the results of Internet monitoring.

The agency’s source also clarified that Gnezdilov is currently on sick leave.

If he does not arrive at the duty station within three days after that, further procedural decisions will be made,” the message said.

Earlier, OK Zahid criticized the soldier’s decision and emphasized that the military man is putting his fellow soldiers under attack by his decision. The command noted that the problem is not in the final term of service, but in the fact that right now Ukraine needs to defend itself, and not engage in public activism.

Resonance post of military Serhiy Gnezdilov

Serhii Hnezdilov is a Ukrainian military man, public activist and participant in the Russian-Ukrainian war. While studying at the Department of Journalism at the Lviv Polytechnic, he volunteered to join the ranks of the Armed Forces of Ukraine at the age of 19 in 2019. For this he took an academic leave. He is an active serviceman of the 56th separate motorized infantry brigade of Mariupol. Brav is trained in battles in Donetsk region, including Pisky and Bakhmut.

On September 21, he publicly announced that he voluntarily left the unit to draw attention to the lack of fixed terms of service under martial law.

From today I go to the SZCH, before the establishment of clear terms of service, or until my 25th birthday, having behind me 5 years of impeccable service as a soldier. I emphasize: flawless. I hope that with this act it will be possible to convey to the authorities and society the need to talk and solve this situation. My position remains unchanged: we must create a mobilization queue from among all Ukrainians conscripted into the military, and then demobilization will become a reality. An armed and trained nation cannot be defeated,” he said.
