The European Court of Human Rights issued a resolution in the case of Nestor Shufrich against the state of Ukraine. The court stood to the plaintiff, but awarded a little compensation.

The ECtHR declared violation of Article 5, paragraph 4 of the European Convention on Human Rights in connection with a protracted court’s consideration of appeals to the decision of the investigating judge. The court awarded the applicant 500 euros as compensation for non -pecuniary damage and 250 euros compensation for court costs.
Shufrich also filed complaints under Article 3 of the Convention on Human Rights, which testifies that “no one should be tortured or inhuman or degrading or punishment.” However, the ECtHR concluded that these complaints either do not meet the criteria of acceptability provided for in Articles 34 and 35 of the Convention, or do not contain signs of violation of rights guaranteed by the Convention or its protocols.
